This Privacy Policy describes how Apex Performance Marketing, Inc., a California corporation doing business as 123 Collabs ('123 Collabs', 'we', 'us', or 'our'), collects, uses, discloses, and protects personal information when you use 123collabs.com, our mobile applications, and related services (together, the 'Services'). By using the Services, you agree to the practices described in this Policy.
1. Who we are and scope
Apex Performance Marketing, Inc., doing business as 123 Collabs, operates the Services. This Policy applies to personal information we collect through our website, our iOS and other mobile applications, and our related business operations.
This Policy does not apply to third-party websites, platforms, or services that we do not own or control, including the social-media platforms you connect to your account.
2. Information we collect
We collect the following categories of personal information, depending on how you use the Services:
- Identifiers and contact details — such as your name, email address, phone number, and company or brand name.
- Account and profile information — for creators, this includes profile details, linked social handles, and publicly available audience metrics.
- Financial and verification information — payout details (such as bank or UPI information), tax identifiers, and government-issued identification collected to verify identity and pay you.
- Commercial information — collaborations, campaigns, deliverables, invoices, and payout history.
- Communications — messages, support requests, and information you submit through our forms.
- Usage and device data — such as IP address, device and browser type, app interactions, and log data, collected to operate and improve the Services.
- Information from third parties — publicly available social-media profile and audience data obtained through our data providers.
3. Sensitive personal information
To verify creator identity and make payments, we may collect information that qualifies as 'sensitive personal information' under California law, such as financial account details and government-issued identification numbers.
We use this information only to verify identity, prevent fraud, meet tax and legal obligations, and process payouts — not to infer characteristics about you. California residents may request that we limit the use of this information, as described below.
4. How we use information
We use personal information for the following purposes:
- Provide, operate, and maintain the Services, including matching brands with creators and running collaborations.
- Send one-time verification codes by email so you can sign in without a password.
- Process invoices, creator payouts, and related financial and tax functions.
- Verify identity and prevent fraud, abuse, and security incidents.
- Communicate with you, including service messages and responses to your requests.
- Analyze, improve, and develop the Services and new features.
- Enforce our Terms of Service and other agreements, and establish, exercise, or defend legal claims.
- Comply with applicable laws and legal obligations, and as otherwise permitted with your consent.
7. How long we keep information
We retain personal information only for as long as necessary for the purposes described in this Policy:
- Account and profile information: for as long as your account is active and for up to 90 days after you delete it, unless we must keep it longer to meet a legal, tax, or regulatory obligation or to resolve disputes.
- Financial, payout, tax, and identity-verification information: for the period required by applicable US and Indian tax, accounting, and anti-money-laundering laws, which is generally up to eight (8) years.
- Contact and lead information from our forms: for up to 24 months after your last interaction, unless you ask us to delete it sooner.
- Technical and log data: typically for up to 12 months.
- After the applicable period, we delete or de-identify the information.
8. Your California privacy rights
If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the CPRA:
- The right to know and access the personal information we have collected about you and how we use and disclose it.
- The right to delete the personal information we hold about you, subject to legal exceptions.
- The right to correct inaccurate personal information.
- The right to opt out of the 'sale' or 'sharing' of personal information — although we do not sell or share your personal information as those terms are defined under California law.
- The right to limit the use and disclosure of sensitive personal information.
- The right not to receive discriminatory treatment for exercising your privacy rights.
9. How to exercise your rights
To exercise any of these rights, contact us at hello@123collabs.com or through the form on our Support page. We will verify your request using information associated with your account and respond within the time required by law (generally 45 days, which we may extend where permitted).
You may use an authorized agent to submit a request on your behalf; we may require proof of authorization and verification of your identity.
California's 'Shine the Light' law (Civil Code section 1798.83) permits California residents to request information about our disclosure of personal information to third parties for their own direct-marketing purposes. We do not share personal information with third parties for their direct marketing.
10. International users and data transfers
The Services are operated from the United States. If you access the Services from outside the United States, including from India, your information will be transferred to, stored, and processed in the United States and other countries where we or our service providers operate. We take steps to protect your information consistent with this Policy and applicable law.
11. Your rights in India (DPDP Act, 2023)
If you are located in India, you have rights under the Digital Personal Data Protection Act, 2023, including the right to access, correct, and erase your personal data, to nominate another person to exercise your rights, and to seek grievance redressal. We process your personal data based on your consent or as otherwise permitted by law.

12. Data security
We use reasonable technical and organizational measures designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
13. Children's privacy
The Services are intended for businesses and for creators who are at least 18 years old. The Services are not directed to children, and we do not knowingly collect personal information from anyone under the age of 13 (or under 16 where applicable). 14. Changes to this Policy
We may update this Policy from time to time. When we do, we will revise the 'Last updated' date above, and material changes will take effect when posted or as otherwise required by law. Your continued use of the Services after an update means you accept the revised Policy.
